Appeal

After we submit your application, your Local Authority will review it, then notify us of their decision.

If they reject it, we will notify them of your intention to appeal. We will then prepare your appeal.

An essential point to note is that the Appeal authority is not the same authority that rejects your intial appeal. Where the local authority may reject your application for reasons other than the law, the DPEA considers your application strictly in terms of the law -- specifically, whether your case presents a material change of use.

The DPEA will review our appeal, then notify us of the outcome.

The process is shown below. Note carefully the durations of each of the stages. You may continue to trade all the way until receipt of the outcome of any appeal. Depending on the extent to which the planning system becomes overloaded by applications, these durations may be longer in practice.
